When you are writing the lay off memorandum you must, at a minimum, cover these topics. You should record any significant comments by the jobholder, such as "I knew this was coming. When using a worker discipline form you not only tell the insubordinate employee that their behavior is unacceptable, but you also have written evidence of the issues. You can frequently separate for the first instance of insubordination. With a good letter, you can uphold a calm, professional manner no matter what the jobholder says or does in the lay off meeting. Separation forms are useful whether you must write a dismissal letter or to write up an incident for the employee's permanent file. This includes (in most states) those personnel who are engaging in a labor strike. Therefore, you'll be consistent in practice and won't have to worry about wrongful discrimination claims. Well-written notices of separation can ease the pain of separating. Your worker has the right to remain on your insurance for up to 18 months after lay off, but he or she will have to pay the company-paid portion of the insurance. The person sacking executive level workforce should keep this in mind and reinforce the decision with substantiation of misconduct, poor work, or whatever caused the dismissal.

Remember former workers can begin a smear campaign against you and the small company and this will only add to your current problems. You must interact openly with your team members and show respect for their opinions and ideas.
